SMS Messaging Consent & Opt-In Policy

Overview
OpsScaleIQ (“we,” “our,” or “us”) is a multi-location business operations SaaS platform. OpsScaleIQ enables its business subscribers (restaurants, retail stores, fitness studios, hospitality operators, and other multi-location enterprises) to send transactional SMS review-request messages to their own customers.
This page describes exactly how end-customer consent is collected, what messages subscribers can expect to receive, and how to opt out at any time.
Who Sends These Messages
SMS messages are sent by OpsScaleIQ on behalf of its business subscribers (the individual business locations using our platform). The sender is always a business whose customers have explicitly provided their phone number and consented to receive SMS communications from that business.
OpsScaleIQ acts as the technology provider. The business subscriber is the originator of the relationship with the end customer.
How Opt-In Consent Is Collected
Consent is collected by the business subscriber via a web form opt-in before any SMS is sent. The opt-in flow works as follows:
- A customer of the business (e.g., a restaurant guest, retail shopper, or gym member) voluntarily provides their name and mobile phone number — either in person, through the business's own intake form, or through a loyalty or feedback form.
- The customer sees clear consent language at the point of collection, for example:
“By providing your phone number, you agree to receive SMS messages from [Business Name] including requests for feedback and reviews. Message & data rates may apply. Message frequency varies. Reply STOP to unsubscribe at any time.”
- The business subscriber imports these opted-in contacts into the OpsScaleIQ dashboard (via CSV upload or manual entry) and certifies that each contact has given explicit prior consent.
- OpsScaleIQ's platform displays a confirmation checkbox to the business operator before any campaign is sent, requiring them to confirm that all contacts have consented.
OpsScaleIQ does not send SMS messages to any contact who has not gone through this opt-in process. We do not purchase contact lists or send unsolicited messages.
Types of Messages Sent
SMS messages sent through OpsScaleIQ are transactional review requests only. No promotional, marketing, or advertising content is sent. A typical message looks like:
- Messages are sent once per campaign trigger — not on a recurring schedule.
- Message frequency: typically 1 message per customer per campaign (low frequency).
- Standard message and data rates may apply.
How to Opt Out
Customers can opt out at any time by replying STOP to any SMS message they receive. Upon receiving a STOP reply:
- The customer is immediately removed from future SMS sends.
- An automatic confirmation message is sent: “You have been unsubscribed. You will not receive any more messages from this number. Reply HELP for support.”
- The opt-out is recorded and enforced by Twilio's infrastructure — the business subscriber cannot override it.

Regulatory Compliance
- All SMS campaigns comply with the Telephone Consumer Protection Act (TCPA) and applicable FCC regulations.
- Business subscribers must agree to OpsScaleIQ's Terms of Service, which prohibit sending SMS to contacts without prior express written consent.
- STOP, HELP, and CANCEL keywords are handled automatically by our carrier infrastructure — they cannot be disabled.
- Every message contains an opt-out instruction (“Reply STOP to opt out”).
- Message and data rates disclosure is included in the opt-in consent language.
